Welcome to EzBillGuru. These Terms of Service ("Terms") govern your access to and use of the EzBillGuru software (the "Software") and any related services offered by the developer. By downloading, installing, running, or otherwise using the Software you accept these Terms.
The Software is provided by an individual developer (referred to in these Terms as "I", "me", "the developer" or "Provider"). You — the person or entity using the Software — are the "User".
Subject to your compliance with these Terms, I grant you a non-exclusive, non-transferable, revocable license to use the Software for internal business, testing, evaluation, educational purposes and for small retail shop usage.
Attribution requirement: If you distribute, repackage, publicly demonstrate, or sell the Software (including modified versions), you must retain clear attribution to the original developer. At minimum, the attribution must include the developer name (or "EzBillGuru / individual developer"), and a link to the original project or website (for example: ezybilling.in or another URL the developer provides). You may not remove or obscure any author credits included with the original distribution.
This Software is provided primarily for testing, feedback, and early-stage use. It may be incomplete, include experimental features, and can change at any time. I may later offer the Software as a commercial/business product. Your use of the Software today does not create any ownership rights in the developer's trademarks or future products beyond the rights in the license above.
The Software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory. I expressly disclaim all implied warranties including, but not limited to, warranties of merchantability, fitness for a particular purpose, security, reliability, accuracy, and non-infringement.
To the maximum extent permitted by applicable law, the developer and affiliates will not be liable for any indirect, incidental, special, consequential or exemplary damages (including lost profits, loss of data, business interruption, or loss of good will) arising from or related to your use of the Software, even if advised of the possibility of such damages.
You acknowledge and agree that in no event will the developer's aggregate liability for claims arising out of or relating to these Terms or the Software exceed the greater of (a) the total fees you actually paid to the developer for the Software in the past twelve (12) months, or (b) one hundred U.S. dollars (USD $100). If you have not paid any fees, then the limit is USD $0.
You are responsible for the security of your data and for applying appropriate operational security controls (backups, access controls, secure deployment). While I will make reasonable efforts to follow secure development practices, I do not warrant or guarantee that the Software is immune to hacking, data breaches, malware, or other security incidents.
I am not responsible or liable for any loss, disclosure or corruption of data, unauthorized access, or damages resulting from hacking, security vulnerabilities, third-party integrations, or misconfiguration. You must maintain your own backups and take appropriate precautions before using the Software in production.
I may, at my discretion, provide support, updates, upgrades, or commercial services. If you request or acquire paid services (such as customization, hosting, integration, or upgrades), those services will be subject to separate terms and fees. Nothing in these Terms requires the developer to provide support or maintain the Software unless a separate agreement is signed.
You agree not to use the Software in violation of applicable laws or to infringe third-party rights. You are responsible for compliance with tax, accounting, data protection and other legal obligations when using the Software in your jurisdiction.
All intellectual property rights in the Software (including code, design, assets, trademarks and documentation) are and will remain the property of the developer except for third-party components licensed to you under their own terms. You are granted only the limited license stated above.
These Terms are effective until terminated. If you breach these Terms (including the attribution requirement), the developer may terminate your license and your right to use the Software. Sections that by their nature should survive termination (warranty disclaimer, limitation of liability, intellectual property, and indemnity) will remain in effect.
These Terms will be governed by and construed in accordance with the laws of the developer's country/jurisdiction (unless otherwise agreed). Any disputes will be resolved in the competent courts of that jurisdiction, unless the parties agree in writing to alternative dispute resolution.
I may revise these Terms from time to time. Continued use of the Software after a posted change constitutes acceptance of the new Terms. If I introduce material changes to rights or obligations, I will attempt to provide notice.
